The general terms and conditions of operation and use of the www.fragrance-perfumes.eu website are drawn up in accordance with the Slovenian Consumer Protection Act and other legislation applicable to Internet sales and to this type of business. These terms and conditions govern the operation of Sostasa d.o.o. and the business relationship between Alsta d.o.o. (hereinafter referred to as: ”Alsta d.o.o”), registered users (hereinafter referred to as “users”) and buyers of goods or services (hereinafter referred to as “buyers”).
Fragrance Perfumes is a website selling fragrances inspired by original perfumes, manufactured in the city of Milano, Italy.
Due to the nature of the business, the products listed on the website may change on a daily basis. The prices of each product are regular and offer or discounted prices.
Sostasa d.o.o. shall be held liable for the quality of the goods or carrying out the service. Sostasa d.o.o. shall also be held liable for any complaints or consequences that may arise when the user uses the goods or services. Carrying out the services or the sale of products and any related complaints shall be the sole responsibility of Sostasa d.o.o.
Photographs, images or videos published in the context of what is offered are the property of Sostasa d.o.o. or its suppliers, business partners or are purely symbolic and do not represent the exact characteristics of the product or service and may depict a symbolic or actual service, offer, company or goods.
Sostasa d.o.o. acts as a company offering goods or services via the internet.
The buyer pays the invoiced amount to Sostasa d.o.o. and receives an invoice together with the goods or services. The company operates on the territory of Republic of Slovenia.
We ship the products within the EU.
By registering, the visitor/buyer becomes a user and obtains the right to purchase and access all distance contract details.
The sales contract between Sostasa d.o.o. and the buyer is concluded in the online shop www.fragrance-perfumes.eu at the moment when Sostasa d.o.o. sends the buyer the first e-mail about the order status (address: www.fragrance-perfumes.com – subject: Order no. _ confirmed ).
From that moment onwards, all prices and other terms and conditions are fixed and are binding for both Alsta d.o.o. and the buyer. The buyer is the person whose details are given at the time the order is placed. It is not possible to change the buyer’s details at a later date.
The sales contract (the first e-mail about order placement and order status) is stored electronically on Alsta d.o.o. server.
Each shipment also contains a physical invoice, which the customer can also receive by email.
The seller must issue an invoice for the supply of goods or services and hand it to the buyer. The buyer must accept the invoice and keep it immediately after leaving the business premises.
Shopping at www.fragrance-perfumes.com is safe, easy and convenient. The buyer must ensure that their details are correct and true, regardless of the payment method, so as to ensure that the goods are delivered to the correct address within the specified timeframe.

The products will be delivered (via GLS delivery service) to the address provided during the registration or purchase process. We recommend that you provide the address of the location where you are in the mornings. We also recommend that you submit a mobile number at which you can be reached in the morning, so that the courier can call you to arrange the delivery. The telephone number will be used only to improve the delivery quality.
The courier can deliver your parcel to the address provided when you placed the order, or to another address if that’s more convenient for you.
If you are unable to collect your parcel on delivery, arrange another option with the courier.
The prices of all goods or services offered are fixed in advance and include VAT.
The prices are valid for all buyers, but only for the duration of the individual offer and in the case of payment as stated in these terms and conditions, and only on the www.fragrance-perfumes.com website.
Prices are valid until product delivery. We reserve the right to change prices.
Prices are rounded to two decimals.
The user can place an order as a guest or as a registered user.
To see the order history on www.fragrance-perfumes.com, add products to favourites and keep track of products that are currently out of stock, the user needs to register. The user provides their details, email address, delivery address and other information. The username is assigned by www.fragrance-perfumes.com and represents the user’s email address. The first password is provided to the user by www.fragrance-perfumes.com, afterwards, the user can change the password at any time. The password will be sent to you by email. Registration enables the user to make a purchase.
– The user is assigned a username, which is the same as their email address, and a password (the password can later be changed). The user receives the password to their email address, which can be used to access the profile.
– The user chooses from the products offered, selects the payment method and makes the purchase.
– Once the offer ends (after the expiry of a certain period or after all stocks have been purchased), the offer is withdrawn from the website or the information “unavailable” is published.
– On the “My Account” tab, the users can view their order status, order history and favourites.
– The user is also sent an informative purchase notification to their email address.
– A purchase is completed when the user makes the payment in the correct way.

Alsta d.o.o. reserves the right to withdraw a product or service from the offer for any reason.
Purchase abuse constitutes an offence.
After placing an order, the customer receives an email notification that the order has been accepted into the queue. The buyer has the right to withdraw from the distance contract until the goods are dispatched (“order is being prepared” status) (the order must be cancelled by email to narocila@fragrance-perfumes.com ). In doing so, it is necessary to include the order number. The email address used to cancel the order must match the email address used to confirm the purchase. If the buyer does not cancel the order, the order is processed further. The seller may call the buyer’s contact telephone number to verify the information or to ensure the accuracy of the delivery. Upon order confirmation, the supplier shall inform the buyer about the estimated delivery time by e-mail. At this stage, the purchase contract for the ordered items between the buyer and the seller is irrevocably concluded. The details of the distance contract are always available on the www.fragrance-perfumes.eu server, which the buyer can access using the username and password upon placing the first order. Prices are valid at the time of placing the order and do not have a predetermined validity.
If the buyer fails to pay the amount or the advance payment due under the pro forma invoice when being requested to do so by the seller so as to provide proof that the transaction is concluded in earnest, it shall be deemed that the buyer has not accepted the offer and the contract has not been concluded. Sostasa d.o.o. shall immediately inform the buyer thereof.
Payment with a payment card is secure, as Alsta d.o.o. ensures technological and organisational means to protect the transmission and storage of personal data and payments. Authorisations and payment card transactions are secure and handled in real time with instant data verification with banks. Card data is not stored on the server.
When registering or making a purchase, the buyer allows Sostasa d.o.o., Podbreznik 15, 8000 Novo mesto to collect, process and store the personal data submitted in accordance with the Slovenian Personal Data Protection Act.
Alsta d.o.o. undertakes to protect user data with due diligence and in accordance with the law.
The data is collected on the basis of the individual’s personal consent and for a period of five years or, if the Personal Data Protection Act stipulates otherwise, for the stipulated period.
Personal data is collected for the purpose of carrying out the orders or offers without interruptions, communication with the customer, statistical analysis in order to improve the functioning of the website and services and, if so chosen by the customer, to send notification, news and offers (via email) until the customer submits an unsubscribe request. The newsletter also includes exclusive offers for registered subscribers only.
In this regard, the following data are collected:
IP address,
first and last name,
address of permanent or temporary residence and delivery address,
telephone number,
e-mail address,
time and date of registration; and
archive of communication with the online shop.
Alsta d.o.o. respects the privacy of the users of the www.fragrance-perfumes.com online shop and undertakes to protect the personal data obtained with due diligence and not to disclose it to any third party without consent or to use it other than exclusively for the purposes stated above, except in cases where this information is requested by a competent state authority with a legal basis for doing so and in cases of a suspected misuse in the course of business by the website user. The procedure is confidential. If no agreement can be reached, any disputes shall be resolved by the court in Novo mesto.
Complaints relating to the quality or processing of the offer shall be settled between the buyer and Alsta d.o.o.
The www.fragrance-perfumes.com website operates under the principle of catalogue sales of goods and services. Despite our best efforts to keep the offer as accurate and up-to-date as possible, it may happen that the information about the goods and services as well as the price changes so quickly that we are unable to correct it and it remains unchanged on the website. In the case an order is placed for such goods or services, the company shall inform the customer of the changes and cancel the purchase or give the customer the opportunity to cancel the order or make alternative arrangements.
We reserve the right to typographical errors and errors resulting from inadvertent malfunctioning of the website’s IT system.
The company shall not be held responsible for the accuracy of information entered by the customer.
Delivery takes 2 to 3 working days – no delivery takes place on weekends and public holidays.
– The provider shall deliver the goods or services within the agreed time-frame.
– GLS is the contractual partner for parcel delivery.
– The shipping costs are fixed and amount to EUR 2.50 incl. VAT. Shipping is FREE for purchases over EUR 30.
– In case of cash on delivery, an additional cost of € 1 shall be charged.
– Our partner delivers the parcels in the morning to the address entered when placing the order.
– As the delivery service delivers in the morning, you can also opt for delivery to any other name or address.
– If you are not at the scheduled delivery location (company, office, etc.) at the time of delivery, the courier will leave a message with instructions for later collection.
– If the buyer does not receive the goods within a few days of dispatch, the buyer shall immediately inform the seller.
– In this case, the supplier shall determine the cause and inform the buyer.
How long will it take to receive my order?
The order will be delivered within 2-3 working days (if the order is placed on the same day by 1:00 pm, *on Mondays by 11:00 am). No delivery takes place on weekends and public holidays.
How much are the shipping costs?
The shipping cost is fixed (€ 2.50) and does not depend on the quantity ordered. Shipping is FREE for purchases over EUR 30. The package can be paid for to the GLS courier in cash or by credit/debit card at the time of delivery.
In case of payment upon delivery, an additional charge of EUR 1 applies.
If the delivery attempt is unsuccessful, the GLS courier will leave a message to inform you of the parcel. The message contains the parcel number and the phone number of the GLS delivery service and their email address (info@gls-slovenia.com).
How can I collect my products via GLS?
The delivery of products ordered in our online shop is carried out as soon as possible and is subject to product availability. The products will be delivered via the GLS delivery service to the address you provided during the registration or purchase process, we recommend that you provide an address where you can be reached in the mornings. We also recommend that you submit a mobile number at which you can be reached in the morning, so that the courier can call you to arrange the delivery. The telephone number will be used only to improve the delivery quality.
The courier can deliver your parcel to the address provided when you placed the order, or to another address if that’s more convenient for you.
We deliver the ordered goods on the territory of the Republic of Slovenia and the EU.
Parcels are dispatched 5 times a week from the central warehouse at Alsta d.o.o., Mušičeva ulica 15, 8000 Novo mesto.
Damage during delivery
The buyer should inspect the parcel contents upon receipt. If the parcel is damaged, the buyer shall return the entire parcel (package, protective packaging, products) to Alsta d.o.o., Mušičeva ulica 15, 8000 Novo mesto, and Alsta d.o.o. shall provide a replacement parcel.
It is deemed that the purchase is made via a distant contract. The language in which the contract is concluded shall be SLOVENE.
RIGHT OF WITHDRAWAL FROM THE CONTRACT
The buyer may request (in writing, by email, by telephone or in person) a distance contract and may receive it by post to their address, in electronic form by email or may collect it in person at the company’s registered office.
The buyer shall have the right to notify the company within fourteen (14) days from the date of placing the order that they withdraw from the order without being required to provide a reason for this decision. If the buyer has already received the goods, the buyer has the right to notify the company in writing within fourteen (14) days of receipt that they wish to return the goods. If the buyer has already paid for the goods, the company must reimburse the buyer the purchase price paid immediately, or at the latest within fourteen (14) days after receiving the withdrawal notice. The seller may withhold the refund of payments received until the returned item is accepted or until the buyer provides proof that the item has been returned, unless the company offers the option to take over the returned item itself.
In the event of withdrawal from the contract, Alsta d.o.o. shall immediately or no later than within 14 days of receipt of the notice of withdrawal from the contract refund all payments received. The buyer must return the item to the seller undamaged and in the same quantity, unless the item is destroyed, damaged, lost or its quantity has decreased without this being the fault of the buyer. The buyer may not use the items freely until withdrawing from the contract. The buyer may inspect and test the items to the extent strictly necessary to establish the actual situation. The buyer is liable for a reduction in the value of the product if the reduction is the result of conduct not necessarily necessary to establish the nature, characteristics and functioning of the product. The buyer shall not have the right to withdraw from the contract for items manufactured according to the buyer’s precise instructions, items customised to the buyer’s personal needs, which by their nature are not suitable for return, items that are perishable or items that have already expired. There is no withdrawal option when purchasing software or audio and video media if the buyer has broken the security seal.
The goods will also be replaced if you have been sent the wrong product because of an error on our part. The full amount of the purchase price (including delivery costs) will be refunded as soon as we receive the returned goods.
THE BUYER DOES NOT HAVE NO RIGHT TO WITHDRAW FROM THE CONTRACT AND RETURN THE PRODUCTS IN THE CASE OF:
– products for which the price is dependent on fluctuations in markets over which the company has no control and which may occur within the withdrawal period;
– products that have been made to the user’s precise specifications;
– products that have been tailored to the user’s personal needs;
– products that are perishable or have already expired.

The buyer may exercise their rights arising from a material defect if they notify the seller (Sostasa d.o.o.) of the defect within two months from the day on which the defect was discovered. The buyer must describe the defect in more detail in the defect notice and allow the seller to inspect the item. The buyer can notify the seller of the defect in person, whereby the seller must provide the buyer with a receipt, or by sending the item to the shop where it was bought or to the seller’s representative with whom the buyer has concluded the contract. The seller is not liable for material defects of the product that become apparent after two (2) years since the product was delivered to the buyer. If the subject of the contract between the seller and the buyer is a second-hand item, the seller is not liable for material defects in the goods that become apparent after one year since the product was handed over. It is considered that the defect already existed at the time of delivery if becomes apparent within six months of delivery.
The defect is considered material:
if the item does not have the characteristics necessary for its normal use or trade;
if the item does not have the characteristics necessary for the particular use for which it being purchased by the buyer, which were known or should have been known to the seller;
if the product lacks the qualities and properties that were explicitly or tacitly agreed or prescribed;
if the seller delivered an item that does not match the sample or model, unless the sample or model was shown only for the informational purposes.
The suitability of the goods for normal use shall be judged by reference to normal goods of the same type and taking into account any representations made by the seller or the manufacturer about the characteristics of the goods, in particular by advertising, product presentation or claims made on the goods themselves.
A buyer who has correctly informed the seller of a defect has the right to request that the seller:
remedy the defect in the goods; or
refund a proportion of the amount paid in proportion to the defect,
replace the defective goods with new, faultless goods; or
refund the amount paid.
If the defect in the goods or an irregularity in the performance of the service is not disputed, the company (Alsta d.o.o.) will approve the buyer’s material defect claim as soon as possible, but no later than within eight (8) days. If the defect in the goods or an irregularity in the performance of the service is disputed, the company (Alsta d.o.o.) will provide an answer in writing to the buyer’s material defect claim no later than within eight (8) days.

The right to a refund in the event of material defects is regulated in more detail by the Slovenian Consumer Protection Act (unofficial consolidated version).
Alsta d.o.o. shall endeavour to resolve any ambiguity, comment or complaint as soon as possible, in doing so complying with the law (Slovenian Consumer Protection Act) and shall make every effort to reach an agreement.

The procedure is confidential. If no agreement can be reached, any disputes shall be resolved by the court in Novo mesto.
Alsta d.o.o. shall confirm the receipt of the complaint within five working days and let the buyer know how long it will take to process, as well as keep the buyer informed on the progress of the procedure. The provider is aware that an essential feature of consumer dispute, at least as far as judicial settlement is concerned, is the disproportion between the economic value of the claim and the costs incurred in settling the dispute itself. This is also the main obstacle to consumers initiating dispute proceedings before a court. Therefore, the provider shall strive to the best of his ability to resolve any disputes amicably.
We do not, in accordance with the legal norms, recognize any provider of out-of-court settlement of consumer disputes as competent for resolving consumer disputes that could be initiated by the consumer in accordance with the applicable laws on out-of-court consumer dispute resolution. Alsta d.o.o., as a provider of goods and services for online purchase in Slovenia and the EU, publishes on its website a link to the Online Dispute Resolution Platform (ODRP). The platform is available to the consumers HERE.
The stated regulation derives from the Out-of-Court Settlement of Consumer Disputes Act, Regulation (EU) no. Regulation (EC) No 524/2013 of the European Parliament and of the Council on the online settlement of consumer disputes and amending Regulation (EC) No 2016/2004 and Directive 2009/22/EC.
Purchasing process at the Fragrance Perfumes online shop
The user can always access comprehensive information on the status and content of the order on the seller’s website. In My Account, users can view orders placed, open pro forma invoices, invoices and goods not yet shipped with shipping deadlines, as well as any other documents.
The purchase process takes place in three steps:
1. step View cart
In this step, the customer reviews the cart to see if it contains all the products in the correct quantities as the customer wishes to order them. In this step, the customer can delete items, change quantities for the individual items and enter a promotional discount code, if the customer has one. The contents of the shopping cart can be saved or printed as a pdf document.
The user can leave the cart and continue browsing and ordering. Products and quantities that have already been added to the shopping cart will remain unchanged.
Once the user has edited their basket, the user proceeds to the next step of the purchase process using the “Checkout” button. The contents of the shopping cart can be changed by the user at any step of the purchase process, until the order is completed. All steps allow the return option.
2. step Purchase information
In this step, the customer chooses the delivery and payment methods.
The buyer can choose between the following delivery methods:

3. step Purchase confirmation
In this step, the customer once again reviews the contents of the shopping cart, the data entered and the methods of carrying out the order entered. By clicking “Buy now”, the order is completed and the buyer agrees to the payment method.
To send electronic messages to individuals (SMS, instant messaging, email), the seller uses the Cartfox service. Cartfox privacy policy and information about Cartfox is available here. The controller manages personal data jointly with Cartfox as the provider.
Personal data of data subjects processed in the Cartfox service are:
Personal data (email address, telephone number) is automatically transmitted to the joint controller, Cartfox as the service provider, when the data is entered by the data subject on the website or in the controller’s application.
The legal basis for processing personal data when using the Cartfox service is:
Each message received contains instructions on how to unsubscribe in a simple manner. By unsubscribing, the recipient only unsubscribes from receiving Cartfox messages. If you wish to unsubscribe completely from all communications sent by the controller, contact us at sales@dfvu.org.
The purpose of the processing of personal data in the context of the Cartfox service is to encourage recipients to purchase goods or services on the website or in the controller’s application or to check their willingness to enter into a contract (e.g. when sending a notification about an abandoned shopping cart).
Within the Cartfox service, personal data is not transferred to third parties (other than the joint controller, Cartfox as the service provider) and is not accessible by the controller. The controller may only access reports within Cartfox that contain aggregated and thus anonymised data (e.g. number of messages sent, number of purchases via messages sent, etc.).
Personal data processed in the context of the Cartfox service is not transferred to third countries or international organisations, i.e. it is not transferred outside the territory of the EU Member States.
Information on the retention period of personal data processed within the framework of Cartfox, on protection of this personal data and on the rights that individuals have in relation to this personal data is available in the CARTFOX Privacy policy.
